Arrest, foreclosure: As trial nears, woes swarm elder Huguely

The father of accused girlfriend-killer George Huguely V has had his own run-in with the law, and is facing three charges related to alleged drunk driving in Montgomery County, Maryland.

According to the Washington Examiner, George Wesley Huguely IV was arrested September 20 in Potomac after a police officer observed a dispute between Huguely and two joggers in which one of the runners allegedly hit Huguely's black Chevrolet Suburban. The officer followed the SUV and observed it driving erratically and going through a red light.

Huguely, 56, took a field sobriety test and was taken to the police station, where he refused to take an alcohol breath test, the Washington Post reports. He was charged with driving while under the influence of alcohol, driving while impaired by alcohol, and for failure to obey properly placed traffic control device instructions.

Huguely père has had a series of financial setbacks since his son was arrested for the murder of Yeardley Love in May 2010, weeks before the two UVA lacrosse players were set to graduate.

Last December, an eight-acre parcel he owned on Morgantown Road in Ivy was scheduled for foreclosure, forestalled temporarily by the bankruptcy of a West Virginia partnership of which Huguely IV is the general partner.

Reports says he owes more than $1 million on his River Road home in Potomac, which is under foreclosure, and he's requested foreclosure mediation, the Examiner reports.

According to court testimony, Huguely father and son played golf together on May 2, 2010, the last day Love was alive. Huguely V has been jailed since May 3, 2010, and goes to court in February. Huguely IV goes to trial April 3.

On Thursday, December 1, the elder Huguely was dealt a further setback when the judge in the case, Edward Hogshire, ruled that the family must decide whether to attend trial or speak up during the potential sentencing phase. Under Virginia law, no witness can watch the trial over the objection of the prosecutor.

"The statute is very clear," argued Commonwealth's attorney Dave Chapman, "It's unequivocal in its terms."

Huguely lawyer Fran Lawrence argued otherwise– that Virginia's so-called bifurcated trial process– which seems to separate the guilt and penalty phases– should allow the parents and other family members to provide support during the trial without getting excluded from offering glowing character witness during a  sentencing.

"Our concern is the family members were faced with a dilemma," Lawrence told the judge. But the judge– who also excluded the possibility of letting family testify via video– ruled against such efforts.

"To me," said Hogshire, "it's not even a close call."

Based on "innocent until proven guilty", I have never understood how someone who has not been found guilty in a court of law can be in jail for over a year. An an institutional level, isn't that making someone who could very well be innocent do jail time for something they didn't do?

@ U.H.G. - He's admitted to kicking in Yeardley's door and beating her up, including repeatedly slamming her head against a wall, which, according to law enforcement, caused her death. Now it's a matter of his lawyers trying to prove that the beating he administered wouldn't have been enough to cause her death. Hence, why they're nitpicking what substances she could have had in her system, and trying to get a hold of her medical records. But the fact that he psychotically kicked in her door and physically assaulted her has never been denied. And that in itself is reason enough for many people to keep him locked up in the meantime.

He could get a speedy trial if he wanted one. He doesn't. You have safeguards (in the form of the judge) making sure than the holding before trial process isn't abused. I am sure there are instances where it is, but this isn't one of them.

@ boo: You got me on that one! Unfortunately, I make that mistake 99% of the time. The name "Courtney" is firmly implanted in my mind even though I don't even follow rock music or it's vocalists. Seriously. In my defense, at least "Courtney" and "Yeardly" both end with "ly". I even attended my kid's graduation on The Lawn and Casteen specifically mentioned Yeardly Love in his Commencement Address", so I should know better. But I'm sure I'll continue to make that faux pas.

At least I know enough to not want her killer, alleged or otherwise, to be roaming free on bail pending trial. For whatever reason, the moderator deleted my comment, perhaps because I mentioned the ACLU in a negative light. Go figure.

One more comment on Huguely the 4th, 5th, 10th or whatever number he is in a long line of privileged elites (at least, unless he has a brother, there won't be any more of them). He should be thankful he's serving extra time in the local lockup because it's that much less time he'll have to spend at Big Boy's prison at Nottoway, Sussex or whatever he**hole he winds up at, for the rest of his life. Maybe that's part of the reason for his attorney's delaying tactics. He should also be thankful his trial isn't in Prince William County or there might be a needle in his future.

Thanks to all the money being spent on lawyers, Daddy won't have as much to spend on booze, so maybe there won't be as much DUI in his future.

I hope he goes to the supermax facility near Abdingdon.

Someone can default on property and still have personal wealth. It is all in how you structure the deals and if you know how to keep personal and business dealings seperate. I seriously doubt he will be participating in Occupy Cville anytime soon.

Cheryl Tweedy, in addition to what discoduck said, income is much more important than wealth in the grand scheme of things. I doubt many a night will come along where George Wesley Huguely IV will be eating Hamburger Helper and drinking $6 a bottle wine..

Yup, George the IV is far from broke, just the folks who extended him credit are screwed. Just another fine example of the character this family exhibits. With the Penn State and Syracuse scandals, I am still amazed UVa was able to protect Starsia the way it did. He was able to claim ignorance and get away with it. Penn State needs to hire whoever UVa used to pull that one off, or maybe it is just the media is so lame around here. There was no investigative reporter around here without ties to UVa to dig up the truth.

I hope Starsia has to appear at the trial and testify under oath as to what he knew when.

It's the disease that keeps on giving...especially in families.

Would hope he won't be able to afford all those highpriced lawyers to get George IV off lightly.
