Asleep at the switch? Discrimination alleged at retirement community

Three months after Charlene Smith was fired, she's still angry about what she calls her "wrongful termination," and she alleges there's a pattern of discrimination against minority employees at Westminster-Canterbury of the Blue Ridge.
"I was falsely accused of sleeping on the job," says Smith, a certified nurse assistant who had worked at the posh Pantops retirement community for more than a year. She says she was folding laundry at the end of a double shift at 7am April 4 when a nurse she'd never seen before came in. When Smith returned to work that afternoon at 3pm, she was called into the nurse manager's office and told she was fired for sleeping.
"I was so upset," says Smith. "I was hysterical. I couldn't believe they'd make up something like that."
Smith contends that she was not asleep, but if she had been, she should have been written up like a white employee who was found sleeping three times, including once by the facility's chief executive officer– but who was not fired until a month after Smith's termination.
And that, Smith alleges, is a pattern at the facility, where black employees are fired for things that white employees do with impunity. She's filed a complaint with the Equal Employment Opportunity Commission.
"I would have to disagree with her," says Suzanne White, director of human resources at Westminster-Canterbury, which employes 270 employees, 41 percent of whom are minorities. "We are a nondiscriminatory organization based on sex, race, religion, national origin, and age." White says that in the 16 years the facility has been open, there have been no other EEOC complaints.
Smith says there is only one black employee in management and no full-time black nurses work day shifts.
"There is one African American in our leadership group," confirms White, and that translates to eight percent of management.
White says Westminster's policy for those found sleeping is termination. "There is an investigation, then you meet with the employee to review. This is confirmed by the supervisor and a coworker," she explains.
That's not Smith's understanding of the consequence of dozing on the job. "The policy says send the employee home," she says. "That's what I heard at the [October 25, 2007, nurses] meeting. They will be sent home and talked to the next day. The policy says nothing about termination– even if it happened." She says she was never counseled about the incident.
"Maybe she didn't view it that she was being counseled," says White. "They asked her if she had been sleeping, and she confirmed the allegation." White adds that she was not present at Smith's exit interview, but says, "I have no reason to doubt that."
Smith vehemently denies that she was sleeping, and shows a reporter a copy of the termination papers she refused to sign because, she says, it was untrue: "It wasn't counseling– it was termination. I had no previous write-ups and no verbal warnings."
She also shows a stack of letters– recommendations from her previous employers at Piedmont Virginia Community College, UVA, and attorney Steve Rosenfield.
Buckingham native Smith, 37, a single mother, says she got her CNA license in 1990 so she'd always have a job to fall back on.
"I've never had any complaints from the Nursing Board until now," she says, the result of her dismissal from Westminster-Canterbury. "My unemployment benefits were turned down because of false accusations. Now they're trying to harm me by having my license suspended." She also says that by being fired on the spot, she lost her accrued vacation pay.
"If you leave without notice or are terminated, you forfeit those hours," White confirms.
Blondie Paige has worked five years as a part-time nurse at Westminster-Canterbury, and she says she's seen incidents that seem discriminatory, such as the white CNA who was not fired on the spot for sleeping. She mentions an African-American employee who worked there 16 years with no complaints and was fired for "patient abuse" on the word of another employee when he accidentally squirted water in the face of a resident he was bathing.
When Paige started working at the facility, she says, there were no other black nurses. "They kept saying, no black nurses would apply," says Paige. "I knew nurses who applied and were told there were no positions. One unit there still has no black nurses.
"I think the facility thinks because it's private, no one will complain," she continues. "They say we're in a right-to-work state– that's an implied threat."
Westminster does have a formal grievance procedure for employees who believe there's been an unfair application of procedure, White says, as well as an open door policy with management. "Every employee has a copy of that in the employee handbook," she says. "We review it on the first day."
"When I was hired, no one gave me a handbook," says Smith, nor was she offered the grievance options when she was terminated. Now she's looking at other grievance options: she's retained an attorney.

I actually work at WCBR. Have been there for 5 years as a CNA. You arent getting the WHOLE story here nor does she explain "hysterical" accurately, she was IRATE, she verbally abused several employees on her way out, right in front of the residents. I was there, I saw it! She lacked professionalism the day she was terminated and refused to sign the termination paperwork because she has an issue with authority and she was pissed.
The part about the employee of 16 yrs wasnt the whole story either! He wasnt fired for spraying water, it was for more than that - he verbally abused a resident.

WCBR is a great place to live and to work. The management has been fair and I love my job! I dont think that race really had anything to do with any of this! I also dont think that they have a bias against hiring black people, there are tons of black employees! (I might mention that there is only 1 african american resident)....

The UVA School of Nursing is currenting accepting application for interested applicants. But perhaps you wouldn't qualify because you haven't learned how to spell. Are you saying that the government is wasting hundreds of millions of dollars having the EEOC? No, we aren't getting the WHOLE story hear. Since this seemingly happened AFTER she was fired, what does that have to do with anything? Were you there when she had her conversation with the informer or her supervisor or just the exiting? If you overhead the actual conversation between Smith and her superiors then she's not the one behaving unprofessionally. And, no, it is not the responsiblity of an employee to ask for an employee manual. In today's work place, it is the responsibility of the employer to not only give an employee the manual but also to see to it that he understands it fully. You post alone justifies a complaint to the EEOC.

Yes, I am an african american! I'm clearly recall feeling uncomfotable and unwelcomed the day when I stopped by WMCB in order to apply for a CNA position that was advertised in the newspaper. I completed the application and handed it to the HR personel who was very snobish and rude!!! Within a few days after I made numerous phone calls, I received a letter in the mail stating that they WMCB wasn't hiring at the current time. A week later the same exact advertisement was back in the newspaper again. Boy, am I glad that I was able to find someplace else I Now I see why they always keep ads in the paper. Why is there only 1 black employee in a management position out of 270 empoyees?

i also applied for a part-time position with WCBR and was told that they are looking for permanent persons only who has no intentions on climbing the career ladder.no position are guaranteed to be permanent. you can only do the best you can with any position.no i never gave it any other thought about WCBR until now.WCBR has a high profile to obtain. so of course they got to hide the racist issue.so a big THANK YOU to the lady who was fired and treated wrongly for bringing this issue to surface.

oneday i stopped by this LUXURY RETIREMENT FACILITY also to apply for a job and I witnessed an black employee being humilulated right in from of me, over a stupid hotdog bun. WCBR staff and residents were having a picnic functioning. They ran out of buns or something, so the lady went inside to get ask if she could have one because they ran out. The racist cook started to get rude with the lady after she had already informed her that she was an employee but was off duty. I felt so ashamed for the lady. This incident made me feel uncomfortable and I immediately changed my mind about applying for the position because it's clear that they mistreat black employees. I don't know who in their right mind would want to work for them.......

I don't understand how or why unemployment benefits were denied. In a case I am familiar with and based on identical false accusations, and the employer contesting the unemployment claim, the person filing the claim still prevailed.

Furthermore, I don't think this case is based on racism at all. In the case I speak of several black employees were overlooked when sleeping on the job. It was a joke and laughed at in the office. But when a white employee was accused of it, he was terminated.

Sick, are you making up things for arguments sake? Your story seems too convenient. Was your example also involving the same employer or a different one? If different, maybe your employer did not contest the benefits.

I have worked at WCBR during the time that Charlene worked there and also have worked with her through a agency. I am a black CNA and have never been treated unfairly or felt that WCBR is prejudice at all. Charlene is not telling the whole truth about any of this. She is and always has been a negative & rude person. She is probably shopping this story around to any news outlet that will give her the time of day. Why doesn't she mention the deragatory comments that she made against the DON at WCBR several years ago that got her banned from there?

I was like to comment on this story. I commend you Smith for having the courage and heart to take on such a powerful organization. I know alot of blacks who were also wrongfully terminated by WCBR but they were afraid to do anything about it. I hope that the one(s) who are responsible will all get what they deserve!! I myself was accused of Patient Abuse the Patient daughter stated that I slammed the patient down in her scoot chair and did not change the patient. This family member the patient daughter has her picks and choice of nurses assistant who she wants to take care of her mother she even went down stairs and told the people in the head office that she wanted certain CNA's to take care of her mother even give them a list of names But she was told that we did not have the staff for that and the cna's that she requested to take care of her mother has days off some times. THE RESIDENTS DAUGHTER DOES NOT SAY HI BACK TO ME BUT SAYS" WHERE IS LISA?" CVille Eye, no, I am not making up things. In one case a former commonwealth's attorney had to kick one employee in the shin to wake him up. Then the commonwealth's attorney lied about it. Needless to say, he didn't last very long in Charlottesville.

For Whatever: Get your facts straight: 1. There are actually 2 African Americans that reside @ WCBR. 2. You don't know why the 16-yr employee was really fired. My mistake, Over a newly liscensed CNA, whom themselves was cursing in front of other residents (according to the VDHP is VERBAL ABUSE) But was not written up, because the person in charge didn't want any problems. 3. If you know so much about what is going on in management, then that means you aren't doing your job on the floor and other CNA's are taking up your slack. Stop sucking up and do you own work.

Charlene may have verbally abused folks on the way out, but who is happy about being fired? Besides it takes one person to fire someone. Not 1 plus an audience. Plus the girl was doing alot of overtime, perhaps covering one of your shifts Whatever?

I'm sorry to hear that you were also fired for being LIED on! That's exactly what WCBR do to BLACK CNA's. I also see that you wasted your time by going to the Human Resourse office to address the problem. What happened to the OPEN DOOR POLICY that white mentioned in Smith's article? Did White mention to you greivence procedure? Probaly not and Of course White would say that, because she probably a racist herself! I work at WCBR as a full time CNA and I have witnessed alot of racism going on. The BLACK CNA's aren''t treated fairly. The evening shift is always expected to work short staffed. Why, is it because we are BLACK? The only time that management smile in your face is when they want you to work overtime. We are so short of help right now. We dont get our full breaks because they work us like slaves. The management all keep attitudes and like today for example, one in particular walked around with a tight face as though she was angry with the world. She knows that she was wrong for firing Smith and the others without a valid reason. There are at least 12 BLACK employees that I know of that was fired within the last six months. I'm tired of having to walk on eggshells not knowing if I will be the next Black CNA on the firing list to be framed and fired. Im looking for a new job the first thing Monday morning.

My questions are directed to all the WCBR management staff in Healthcare who don't feel as they discriminate, because the POLICY states that they "are a nondiscriminatory organization based on sex, race, religion, national origin, and age."

1.What about the time when the TWO white CNA's who wasn't"FIRED" for failing to PROPERELY DOCUMENT A RESIDENT'S WHEREABOUTS, and the resident was discovered missing for days and who was lated fOUND DEAD across the street during X-MAS time several years ago.(Catered Living Unit)

2. the time when a white nurse(RN)was reported by several Black CNA's who were offended by the insulting degrading comments that she made which was directed at a group of black CNA's
(Healthcare Unit 3)

3. the time when it took several complaints from other black cna's in order for management to consider firing the WHITE CNA who was caught sleeping several times in a chair, including once by the facility's chief executive officer (Healthcare 3)

4.A elderly white CNA who has been allows to work at WCBR for the last 8 yrs who isn't just computer illiterate but illiterate in general because she can't read or write.(Vista Unit)

5.the time when a white cna was reported for "PATIENT ABUSE" and who wasn't "fired on the spot" like the other 4 black cnA's who were fired on the spot but, instead the white CNA was transfered to a different department( Catered Living)

6. the time that a Head Nurse felt that it was legitimate for her to call in because her "DOG was sick!" (Healthcare 2)

7. the time when a white RN receives frequent visits from her boyfriend who wasn't an employee, but is allowed to follow her around on the unit while she's working 9including following her in the patients rooms while she passed medicine.) Separate occasions------But management took discilplinary actions against a black CNA who conversated with her sister who happened to work at WCBR (environmental services at the time) for neglecting to do her job assignment, as the other white CNA's who were also taking to the same person they weren't written up for doing the same thing.(Healthcare 3)

8. white employees are always seem eligible to receive educational scholarship funding, but the black CNA's are denied for reasons such as they have had discipinary actions against them in the past, etc.

9. The White employee who has been employed at WCBR for over 5 yrs, who is allowed to arrive at work DAILY being tardy, and who is allowed to call in whenever she wants, but when a black CNA called in 'twice" she was written up because management considered twice as being "A PATTERN"

I'm sure that I could go on for hours addressing the discriminatory acts that goes on at WCBR, but I won't. However, I do have two final questions; Do you think that any of the white employees that I've mentioned, should have been "fired" or at least "disciplined" for the wrongful things that they have done according WCBR company's policy? How can the Black CNA's not feel as though they have been discriminated against? I'm sure that the public also would like to hear your reply

I have known Smith for over 30 yrs and I know that she would not make up these allegations for the sake of arguement! Smith was a good worker and she was wrongfully terminated. I think that WCBR should treat all employees equally. I have heard about many stories involving racial jokes that have been made by racist staff. For example, the time when man who walks with a limp made a racial comment when He told an black employee that "he couldn't find her without the lights being on!" She felt humiliated by the racist comment even though she is a black light complextion female employee.

If you witnessed her sleeping "every" night, WHAT WAS YOU AND THE SUPERVISOR, DOING? Obviously you were't doing your job by reporting it!

I also work at WCBR and have been discriminated against. But guess what, I'm white. It's not so much a black/white thing up there as it is a rich/poor thing. I'm poor white trash and I get treated as such, only difference is I'm not considered a minority and dont have any EOC to back me up.

And to scratching the surface, two things, first there are 3 African american residents, not two and not that it matters. WCBR is based on money. If you have it you can get in, white, black, jewish, doesnt matter, money talks.

Second, about "The one African American in a leadership position" you forgot to mention she was brought in from out of state by the CEO, not because she was black or white but because he knew that she knew her job. He wanted someone that could run that department, he didnt care what color she was. She's done a decent job of it I might add.

I don't know cerise, don't know if she was sleeping or not, don't know if others were or not but one thing I do know is its not so much what you do but who catches you doing it. A lot of supervisors are understanding, nightshift is hard, they know it and they are likely to let someone off with a verbal if they catch them sleeping. But if like a couple months back the state dept comes in and catches 3 people sleeping, those people are fired on the spot. It's all about perceptions. Not what is, but what seems to be.

First of all I would like to say that this is the 21st century and I have two small daughters that I am trying to raise in a world free of color lines, in a world where a person is a person, no matter if you are black, white, purple, male, female, Jewish or Christian, everyone has feelings and everyone deserves respect. It astounds me that these types of things are still issues today. With that being said, I don't think that it is needed for each person who posts on this board to state their race in the very first sentence, race should not matter, if you have something to say then you have something to say. Next, although WCBR is a place of employment for many people, first and foremost it is a home to a whole lot of people who have nothing to do with this. A home that for the people who live there, should still have some shred of privacy and dignity. It is against the law to discuss freely and openly some of the things that happen in this type of facility that has to do with patient care. It is a major HIPPA violation. And I don't think that any one of you would want your hospital or doctors office talking about you or your care on the computer, to everyone else in the state. Thank you for saying I'm not poor white trash, I like to think I'm not also but many people seem to disagree. I don't need to post specific incidences of being discriminated against, just know that it's happened. I've been there about 3 years now and I've been through a lot of things and seen even more. I have been disciplined for things that others have not. I have not been allowed to do things that others have, some were black, some were white, doesn't matter they were allowed more leniency then I was. A lot comes down to friendships, like high school the place is filled with cliques and if your not with them, they're against you.

And why do you keep harping on the fact that the ES supervisor is black? Do you think ES is not an important job? She worked hard to get there and deserves some respect. Her job is as important if not more so then any other supervisor there! I'd like to see you do her job, or any job in ES for that matter for a week. Want to see what it feels like to get looked down on, give it a try.

As to discussing residents and such, I don't see anything that could be taken as a violation of Hippa as no names have been mentioned or identities given away, but I have seen some very nasty comments about certain employees which if you work there would not be hard to figure who is being talked about. It may not be a violation of any law but it is unkind and hurtful!

Oh and I would like to take the time to tour each unit but I'm too busy cleaning up after the CNA's and others (both black & white) who think they're too good to clean up their own mess.

The bottom line is Smith got fired on the spot with no counseling or verbal warning. Not even a chance to defend herself against the person who claims to have walked in on her SLEEPING.

Another employee who repeadly got caught sleeping(which I witnessed the CEO walk in on her) and nothing was done. But because of who she was she still remained employed.

After Smith was fired the other employee was caught sleeping once again for the 3rd or 4th time and was finally terminated. Only because they just fired Smith, if it wasn't for that she would probably still be employed with WCBR.

Why is Smith being criticized for speaking out? She is the voice of many African American people who are afraid to speak on their own behalf. Afraid of losing their jobs if they speak their mind.

It's clear that WBCR has a BIG PROBLEM with racism. They only have 1 african american in the Leadership Program (in response to Employee) she may have came in from out of state because she knew her job HOUSEKEEPING. Is that the only thing african americans are capable of being in charge of is cleaning? Out of all the management positions at WCBR it's really hard to believe that african americans aren't qualified to do anything except be in charge of cleaning.

The problem seems to start with human resources, telling applicants their are no openings when there really is.

Once again the bottom line is RIGHT IS RIGHT and WRONG IS WRONG. Im glad someone has enough courage to fight for what she believes in. Hopefully one day AFRICAN AMERICANS WILL BE TREATED EQUALLY.

Isn't Virginia an "at will" state? Meaning "any hiring is presumed to be "at will; that is, the employer is free to discharge individuals for good cause, or bad cause, or no cause at all, and the employee is equally free to quit, strike, or otherwise cease work."

Racism? My butt! There was a time when laws were needed to protect black people from being discriminated against. The time is past! They have gotten their equal rights and more, now it's the white people who get discriminated against.

Companies are so scared of getting discrimination charges filed against them that they will hire an under qualified black person over a qualified white person. I've seen it happen; I've been that qualified white person! I have management experience yet when I put in with a certain local store I wasn't even called in for an interview. I thought ok someone didn't like the way I looked or talked or whatever. Out of curiosity I went in a few weeks later and saw who got the job. A young black girl I have worked with before who had no management experience at all. Reverse discrimination at it's finest!

Now if I was black I might have had that job. Not only that but if I wanted to go to college I could get money from the United Negro (do they still call it that?) college fund. If I was a pretty girl I could be in the Miss Black America pageant and if I'm bored I can turn on the Black Entertainment Television. Charlene, I am assuming that you are "Final Comment" You just lost your case with this post. You are claiming racial discrimination yet not only are you rasict yourself, you could very well be sued for slander against WCBR. You just cant let EEOC do there job can you? In case you don't know what that is it's your internet address. It doesn't always give a specific location but it does give the service provider and if that place has a static IP a physical location can be seen. You're not always anonymous on the internet. a good thing to remember.

Now back to the racist thing, please point out where in my post I was racist because I sure don't see it. Racist means I don't like a person souly based on their race or some other factor such as age, sex, or orientation. So in this case it would mean I didn't like you souly for the fact you're black (if you are) First off I don't know what color you are, you've never said I don't think. So unless I did actually know who you are how would I know if you're black? Second off the reason I don't like you is because you're ignorant, not because of your race! You give black people a bad name. Your the type of person that causes racism! If you're referring to your "when was the last time ...." questions. The answer would be - never, because I wasn't around in the time those things were happening, just as you weren't. Maybe even for being white. Sometimes it's subtle, its not always as blatant as having to drink out of a separate water fountain. No i don't work for the hook and no thats not the only way to see IP addys. Maybe for the average person but not for the "3lite" (look it up)There are many programs out there which can enable you to do this if you know what you're doing.

She is a young black woman taking up for her heritage, the same way you would do for yours. She stated she have faced discrimination. Discrimination is discrimination. It should not happen, it could be something small to something bigger, but its still discrimination. She did not make racist comments...she said, you would not like if someone treated you that way. Virginia, that has happened to me several times. The problem goes away as fast as it shows up. Nothing to lose sleep over, the Internet (and software) is not perfect.

Virginia, I just attempted to post a reply to the Mall Death thread. The reply shot off into outer space somewhere. I had to retype it and submit it again before it showed up. Weird.

I've tried posting my message from earlier at least 20 times now. Tried with different email addys, different browsers, and yes different IP addresses. I have it saved now so I can just copy & paste. I tried splitting it up in case it was a word count thing, I even tried switching the paragraphs around to fool any duplication filters they might have but no go. I either get the "duplicate message" or it just goes back to the page and my reply is nowhere to be seen. The only other thing I can think of is I'm possibly using a word that isn't allowed and they've put a filter on. I may rewrite it tonight just to test that theory.

I'm sorry, once, twice maybe three times I could believe but 20+ is no coincidence! Bet this message goes up ok.

Speechless, maybe you need to read what I said again. I wished Charlene the best in her quest, if the allegations are true. That has yet to be proven. I don't feel that I've given Charlene any grief, Kia, yes, Charlene no, and the only reason I did so to Kia was because I thought some of her comments were as racist towards white people as the comments she was speaking out against. I do believe discrimination exists but I believe that applies to more people then just those of African decent.

I stated that I have been discriminated against and was sticking up for my heritage, am I not allowed to do that because I'm white? Thats sure the way it feels nowdays. Or would it be ok for me to start a "White entertainment television" or a "United Caucasian College Fund" What would peoples reactions to that be?? Bet I'd be called a racist or worse. I feel like I'm the one having to defend myself here for feeling that way. Am I not allowed to?

Why is it racist for me to say the laws are overused? I think they are, just as the sexual harassment laws are overused and it's a shame in both cases because when there is truly a case of discrimination or harassment no one cares anymore.

As for it being racist to say that some black people can give all black people a bad name, read further I also said some white people can give all white people a bad name. If I am applying the same example to all races how is that racist. If I was saying all black people are bad and all white are good then it's racist. I'm a bit smarter then that, as I said I've met good and bad in all races that I've encountered.

I do believe the black people who had to fight for their rights would be ashamed of a lot of young black people today. They fought hard to be equal, but whats happening with all the things such as BET and Black history month and such is there's a separation occurring. Again things are becoming black & white, thats not how it was supposed to happen, they wanted their rights, they wanted to be equal, they wanted everyone to be seen as Americans,not as a color. I'm not saying people shouldn't be proud of their heritage, I'm quite proud of mine and think everyone should be proud of where they came from and what their ancestors accomplished. I know mine worked hard to come here and to build something and to become Americans. I'm proud of them, their hard work made me an american. Thats all I want to be, not a spanish american or an irish american not even a caucasian american. That would only cause a separation between people of my heritage and other Americans. It just means when I think about them and what they did it makes me feel good inside, a sense of pride.

My comment at the end wasn't racist either, I just thought it was funny that she claimed a headache from all this after the grief that was given to the guy/gal who said before that they had a headache from it. Read back and you'll see all those things I quoted were things that were said to that person.
