Glenmoregate: Embezzling Comer gets another 3 years

Convicted embezzler Michael Comer stood before a judge today in federal court for the final sentencing in a string of charges that came to light when the Glenmore homeowners association discovered it was missing money–- and its former treasurer.

Kandi Comer, his wife, and her sister, Mo Gaffney, sat in the back of the courtroom as U.S. District Court Judge Norman Moon sentenced a gray-striped, prison-garbed Comer to 36 months on tax fraud and mail fraud charges stemming from embezzlement of Glenmore Associates, PBK Real Estate, and Kessler Enterprises–- companies associated with his wife's family.

Comer had already pleaded guilty. Between 2003 and 2009, he admitted he filed false income tax returns and had $2,548,212 in unreported, taxable income. He agreed to repay the additional income tax that's at least $933,028.

Comer's lawyer, Blair Howard from Warrenton, pleaded with the judge to consider Comer's children and the letters written by his mother-in-law, Peggy Kessler, and sister-in-law Gaffney, both victimized by Comer's financial machinations.

"It's true he betrayed his family," acknowledges Howard. "He used assets to buy a better way of life for his family." That included private school tuition for his two children.

Howard also noted Comer had never been arrested before his July 2009 disappearance, and that he received a glowing letter from the owner of the Jiffy Lube (where he worked for six months before heading to jail in April 2010), who said he'd hire Comer as a manager even knowing his criminal past.

"At its essence, this is nothing but a garden-variety fraud," says Assistant U.S. Attorney Ron Huber. "The fact he uses money to support a lavish lifestyle–- we see it all the time."

"There has to be some deterrent to people so they know there won't be a light sentence," said Judge Moon before sentencing Comer to 36 months on each charge, to be served concurrently, and a $5,000 fine.

The sentence won't, however, be served concurrently with the 18 months Comer's serving on state charges, but Moon did give Comer credit for seven months he's already spent in jail, bringing his federal sentence down to 29 months. Altogether Comer will spend almost four years in prison on state and federal charges.

Before sentencing, Comer stood and thanked his family for their love and support, and vowed to be a responsible, law-abiding citizen when he gets out of prison.

What I never understood is that if he "needed" this money to pay for the kids' private school, etc., then why did he not go to his wealthy MIL or other relatives and ask for help? Why not his wife even? I refuse to believe that the late Frank Kessler did not provide for his children and grandchildren in his will. Hence my belief that what the lawyer is saying is not the full story at all.

@rambo: the difference between what this idiot did and some thug robbing a convenience store is that Comer's was NOT a violent crime. Just think, OJ murdered two people and got off scot free. Maybe Comer should have asked for a change of venue to California where he could get 12 morons for jurors.

Realist, after watching a cop shoppe detective commit perjury on the witness stand, the jury said O J was "not guilty". Having to remind all you guys and girls here all the time is getting old.

realist, if the baseline for comparison is the OJ Simpson trial and verdict, then no crime should ever be punished.

But you should fully realize that you are comparing this guy to a man that literally got away with murder to make your point. That you have to go to such lengths should tell you that you're on the wrong side of this issue.

@gasbag: In the OJ case the jury decided to ignore the evidence and punish the cops and the prosecution by setting OJ free. All because Fuhrman used the "n" word. BFD. Furman is a hero in my book because of the Michael Skakel case in CT. If you think it was appropriate to set a murderer free because a detective was embarrassed to admit he used a racial epithet, then so be it. My main point remains.......Comer didn't commit a violent crime. Also, the money was repaid. Politicians like Charlie Rangel and the current Treasury Secretary have stolen almost as much money by cheating on their taxes, with NO punishment, and nobody seems to care. But a dufus like Comer does a white collar crime involving a few hundred thousand, REPAYS THE MONEY, and some idiots want to put him in prison for life.

Thanks to Fuhrman, her killer was finally caught and convicted. But I'd have to assume, based on what you've written, that Fuhrman somehow planted evidence in that case as well, leading to a miscarriage of justice for Michael Skakel. So I guess it was a good thing that Fuhrman's perjury resulted in that angel OJ not being falsely convicted. Yeah, right.

You shouldn't paint everyone in a profession with the actions of a few but it is true that some police feel the law only applies to civilians . The miscarage of justice in the OJ trial was mainly caused by incompetant prosecuters . They did not try the case in the locality of the crime ,allowed a prejudiced jury to be formed ,allowed Furman to give some false testamony which had no relation to the case ,and they became starstruck with themselves being on daily TV . This traversity could have been remedied if the US laws were enlightened sufficiently allowing both parties an avenue for appeal .

Great point about letting so called blue collar criminals off the hook for the monetary damage caused . Part of criminal sentence should have a realistic and actual monetary judgement made against the criminal in respect to damages . Injured parties should not have the additional burden and expense of being required to file civil suit against useless dangerous low life .

Gasbag ---I don't think he took the fifth when asked specifically about planting or falsifying evidence in the criminal case as it was brought against simpson regarding the murders of Nicole and Ron . I am pretty sure his great sin at the trial was that when asked by F Lee Baily if he had ever called anyone by the " N " word ,he replied no. When asked by F Lee if there were witness to the contrary Furman said that person would be lying . Furman was later shown to be lying on that point when being reminded he used to arrest people for DWB . That is hardly sufficient reason to spring a multiple murderer back onto society , any society in any country . He later showed up with an armed crew but luckily on a fluke didn't kill any more people but now is where he should have been back in 95 .......Any moron on a jury would have realized he was guilty and not released him back to kill more innocent people . The US justice system is sorely lacking in that only one side has appeal rights in such henous crimes .A common sense Law giving the Government appeal rights is missing which adds to the high murder rate in the US . Strange there is no effort to repair that major flaw .

I probably haven't testified in 40 cases over the last 30 years. As a matter of fact, I was the defendant in several of them between 1997 and 2005, anything from a simple traffic case to a false arrest in a felony. But at least the many judges hearing the cases knew I was being truthful in each and every case or I would have been convicted of something. Fuhrman can never say the same.

I think we will have to agree to disagree on many facts in the O J Simpson murder cases. But the bottom line is the criminal jury said he was not guilty of murder. And yet the civil jury said he was responsible for the wrongful deaths.

The civil jury was from a "whiter" area than the inner city criminal jury. They weren't interested in "n" words or the ability to run with a football. It's my understanding that even if the prosecution had tried to have the criminal case tried closer to where the crime occurred, i.e. not have a ghetto area jury pool, the defense would have objected and the trial still would have taken place in downtown LA. Of course, maybe that's just an excuse the incompetent prosecution team gave for effing up in the first place. Throw in a glamour seeking joke of a judge (Ito) who couldn't even control the trial and it was a recipe for disaster. Thankfully, Nevada got it right.

Truthfully, yes, I think O J Simpson is innocent. You have to study the background between Nicole and Mark Fuhrman very carefully to understand why Fuhrman may have had an ulterior motive in setting OJ up for the fall. Or even better yet, tell me how Fuhrman was the first cop on scene even though he was off duty.

You also have to remember I have been there, done that. More than once. After being a deputy sheriff for almost 3 decades in total, I was charged in several fictitious crimes, and cleared by competent judges in all I might add. One trial was a three ring circus with a judge having to hide his laughter of the testimony given by commonwealth witnesses by covering his face and faking a cough. I have seen first hand what cops with ulterior motives are capable of. In the last false arrest, I am a firm believer that the warrant was served in the manner in which it was so as to give a few rookies a justifiable reason to assassinate me. They didn't know the ulterior motive of the cop sitting in the background directing their actions by cell phone. The rookies and myself were all placed in a very dangerous situation by a cop with an ulterior motive.

I'm sorry somebody had to introduce OJ into this discussion. But it frustrates me to no end when people refuse to believe that there's a small handful of lying cops in every city and county who will set people up and insure they will go to trial for a crime they did not commit.

realist, I believe in and place faith in the justice system we have in place in this country. It has served me well as a deputy sheriff, a citizen, and even when I found myself as a defendant in several false arrests. And this same system said the state did not have enough evidence to find O J guilty "beyond a reasonable doubt". Not only did the state not prove it's case, they also introduced the jury members to perjury under oath by a cop, something the jurors probably refused to believe even existed before the trial.

Furthermore, I find it absolutely amazing that DNA is now setting innocent men free after they have already served 15 to 20 years for crimes they did not commit in the first place. It's also a very scary thought when you think about how many innocent people we have put to death in this country before DNA analysis came along.
