FCC rebuked by court in ‘wardrobe malfunction’
Calling it “arbitary and capricious,” a federal appeals court has nixed the $550,000 fine and thereby apparently rebuked Michael Powell, who notoriously added insult to injury when his Federal Communications Commission levied the fine against CBS over Janet Jackson’s famous “wardrobe malfunction” at the 2004 Super Bowl, the New York Times reports. More recently, the former FCC boss has flexed his puritannical muscle by overseeing the ouster of the College of William & Mary’s president over several controversies including the College’s playing host to a sex-worker’s show.
